Terms of use

These Terms of Use govern access to and use of the website operated by FASHION, INC.. They apply to every visitor of the site, regardless of whether a purchase is made, and to every holder of a customer account.

Access to and use of the site implies full acceptance of these Terms of Use. If you do not accept all or part of these Terms, please do not use the site. We reserve the right to amend these Terms at any time; the applicable version is the one in force at the time of your visit, as made available on this page.

• “Site”: all pages, contents, services and features accessible at the address of the website operated by FASHION, INC..
• “User”: any person accessing the Site, whether a visitor, prospect or Customer.
• “Customer”: a User who has placed an order or holds a personal account.
• “Content”: all elements made available on the Site (text, images, video, audio, logos, code, structured data, etc.).
• “Account”: personal area accessible after authentication, gathering personal information, order history, preferences and wishlists.

The site is available free of charge, 24/7, except for scheduled maintenance interruptions or in case of force majeure. FASHION, INC. strives to ensure optimal availability but cannot be held liable for any temporary unavailability due to a technical incident, a force majeure event or a third-party action.

Access requires suitable equipment, an internet connection and a modern browser (Chrome, Firefox, Safari, Edge — current versions). The cost of the internet connection is borne by the User.

Creating an account is optional but provides access to enhanced features (order tracking, wishlist, saved addresses, loyalty programme where applicable). To open an account, the User must provide accurate and up-to-date information and choose a strong password.

The User is solely responsible for keeping their credentials confidential. Any login or action carried out from the account is deemed to be performed by them. In case of suspected fraudulent use, the User must immediately inform customer service and change their password.

The User may request account deletion at any time by contacting customer service. Deletion entails permanent closure of the account; data required by legal obligations (accounting, tax) is retained according to the periods set out in the Privacy Policy.

The User undertakes to use the Site in compliance with applicable laws and regulations, and in particular not to:

• Publish or transmit, by any means, content that is unlawful, abusive, defamatory, racist, xenophobic, sexual, violent, or contrary to public order or morality;
• Impersonate a third party, create multiple accounts or use someone else's account without permission;
• Attempt to access non-public resources (back-office, servers, databases), bypass security measures or stress-test systems without prior written consent;
• Automatically collect data (scraping, database extraction) or copy site content in bulk without written authorisation, in violation of the database right and the Copyright, Designs and Patents Act 1988;
• Place orders for the purpose of unauthorised resale or fraudulent activities;
• Interfere with the operation of the Site (DDoS attacks, injections, deliberate slowdowns, circumventing rate limits);
• Distribute viruses, malware or any code that may damage the Site or third parties.

Any breach of these obligations may lead to the immediate suspension of access to the Site, the closure of the account, and where applicable civil or criminal proceedings.

Where the Site allows the User to submit content (product reviews, comments, photos, testimonials), the User grants FASHION, INC. a non-exclusive, worldwide, royalty-free licence for the legal term of copyright, authorising us to reproduce, represent, adapt and distribute such content for the purpose of promoting the Site and its products, on all media.

The User warrants that they hold all necessary rights over the content submitted and that it does not infringe any third-party right or applicable law. FASHION, INC. reserves the right to moderate, modify or remove any non-compliant content.

All elements of the Site (text, photographs, illustrations, graphics, source code, databases, structure, trade marks, logos) are protected by copyright, trade mark law and database rights. Any reproduction, representation, modification or distribution in whole or in part, without our prior written authorisation, is strictly prohibited and constitutes an infringement that may give rise to civil or criminal proceedings.

The Site may contain links to third-party sites. FASHION, INC. has no control over these sites and cannot be held liable for their content, practices or policies. Visiting such sites is at the User's sole responsibility; we encourage you to consult their terms and privacy notices.

FASHION, INC. does its best to ensure the reliability of the information published on the Site. However, we cannot be held liable for errors, omissions, or incomplete results, nor for any direct or indirect damage resulting from access to or use of the Site, except where liability cannot be excluded by law or arises from gross or wilful misconduct.

We reserve the right to suspend or terminate access to the Site and close a User account in case of breach of these Terms, fraudulent behaviour, security attempt, or for any other legitimate reason, without prejudice to any damages that may be claimed.
